Equal Employment Opportunity (EEO) and Human Rights Policy Induction

Purpose 
 
The purpose of this policy is to encourage and build a culture that respects and promotes human rights, promotes everyone's rights to equal opportunities and includes minimum standards and procedures for complaints management. 
Standard
 
MultiSkill Centre does not condone discrimination, harassment, victimisation, vilification or bullying including acts in accordance with Anti-Discrimination Act 1991 in education and work related areas.
 
The organisation may, at any time, engage in affirmative action, whereby a previously disadvantaged group of current employees, participants or applicants may be given opportunities not available to all current or potential employees or participants. This is not considered discrimination and is acceptable under this standard. 
Definitions
 
Bullying including cyberbullying
Ongoing or deliberate behaviour that intimidates, offends, degrades or humiliates another employee.
 
Cyberbullying is a specific type of bullying that occurs using internet, social media or other virtual technology means.
 
 
Equal Employment Opportunity (EEO)
All employees, participants, potential employers and potential participants are treated on their merit, without regard to race, age, sex, relationship status or any other factor not applicable to the position.
 
 
Victimisation
Includes any unfavourable treatment of a person as a consequence of their involvement in a complaint.
Rights and Responsibilities 
 
All persons have the right to seek relief or remedy in the first instance directly to the Multiskill Centre, on the grounds of a human rights contravention under s58 Human Rights Act or if they believe they have been harassed, discriminated against, bullied, victimised or vilified. MultiSkill Center will respond within 45 days.
 
Accountabilities - MultiSkill Centre    
On behalf of the organisation, all managers and persons in a senior or supervisory position shall accept responsibility for taking all reasonable steps to prevent issues arising. They must also promptly resolve any issues in the workplace in accordance with this procedure including providing all persons with natural justice. All decisions must be made with Human Rights properly considered and all acts must align with the Human Rights Act 2019.
 
Accountabilities - Employees and participants
It is the responsibility of all employees and participants to respect the human rights of others and never engage in discriminatory or bullying behaviours,harass, victimise or vilify another person.
Complaints resolution procedure 
 
An employee or participant who:
    • Is part of a conflict arising around EEO or Human Rights;
    • Feels harassed, victimised, vilified, bullied or not provided with EEO;
    • Wishes to raise a complaint about a process that does not provide EEO or human rights;
    • Has been asked to breach the Anti-discrimination Act or
    • Disputes a decision made by another person as they feel it does not provide EEO or protected human rights
Is entitled to raise any issue/complaint with their;
Supervisor, Mentor, Manager, Human Resources or Programs Director.
Employees and participants should attempt to resolve issues informally before making a formal complaint.
 
Cyberbullying complaints can also be directed to the eSafety commission without waiting for the MultiSkill Centre's informal process. Please notify your supervisor if you are lodging a complaint with eSafety at the same time.
 
Report online:
 
All issues/complaints raised with Multiskill Centre shall be addressed or investigated and remain confidential.
 
If resolution is not achieved informally, a formal complaint can be investigated. If resolution is not gained via the formal process, the matter can be referred to the Human Rights Commission Queensland.
 
This Standard and Procedure does not limit the right of any employee to seek advice and assistance from their union, professional association or other relevant Government Body.

Non-compliance with this Policy, Standard and Procedure may result in disciplinary action.
